By commissioning Caterina Bragagnolo, the artist, you, the commissioner, are agreeing to the terms of service below.
I. GENERAL TERMS.
Please write your concept in a clear and concise manner. If possible, provide references. Any inappropriate behavior or conduct will not be tolerated and your commission will be canceled if this takes place. If for any reason, I am unable to meet the request made, I have the right to decline your commission.
II. PAYMENT
All commissions must all be paid in full upfront unless the agreed upon contract states otherwise. Payment method and amount will be agreed upon at contract.
III. PROCESS
Once the idea is discussed and a contract is in place, commissioners can request to view 3 versions of the work in progress (WIPS). Within the time allotted to the contract, commissioner can request up to 2 adjustments from the artist, after viewing W.I.P. If additional changes are needed, this can result in a change in fees before receiving the completed piece. A timeline for your commission will be discussed and agreed upon based on composition, complexity and size when the the contract is completed and reviewed.
IV. CUSTOMER SATISFACTION
I will do everything I’m able to in order to provide a quality piece of art for you to enjoy.
However, after a commission is finished, only small changes are able to be made. Please take advantage of reviewing WIP’s thoroughly and share any concerns before the work is finalized in order to avoid additional charges and time extension needed to facilitate said changes after a work is finalized.
To avoid last minute modifications, ensure your reference photos are clear from and be mindful to be direct in communicating what you’re requesting.
V. COPYRIGHT & USAGE POLICY
The artist will hold every right to the produced artwork, not the commissioner.
Legally, The artist is able to use the copyrighted artwork to;
Promote themselves within any place or website.
Include the image in future publications and portfolios
Display the image in print media
Post the image on social media.
The commissioner is allowed to;
Use the copyrighted artwork for personal use, only unless otherwise agreed in the contract.
Use the art to promote themselves with proper credit given to the artist.
If you break the copyright infringement in any way, every right you had to the artwork and associated drawings will be retracted.
The following actions are considered Copyright infringement and illegal;
-Taking sreenshots, Making reproductions or using the copyrighted artwork commercially, without giving credit to the artist.
-Taking credit for the creation of the artwork.
-Removing any watermarks/signatures.
Purchase of Commercial rights to the artwork will always be 300% of the original price. With commercial rights you are allowed to make any merchandise with the artwork, change it to your liking and promote your own brand with.
Artist Credit is still required for usage of the artwork, even if altered or edited.
VI. CANCELING/REFUNDING POLICY
The Artist will maintain the right to cancel and refund the money for a commission at any time.
The Commissioner holds no right to cancel or demand a refund from the artist under any circumstances after payment is received. If money has not been recieved, the commissioner maintains the right to cancel the commission.
If a file is charged against the artist, rights to all artwork previously made will be retracted and the artist will gain the right to sell the copyrighted artwork to new buyers.
Any statement can be bound to change if discussed with the artist, prior to the commission.
